Terms and Conditions of Use

Welcome to Monkey Troopers UAE.
This website is operated by Rachna General Trading LLC, the sole authorised distributor of Monkey Troopers products in the United Arab Emirates.
By using this website you agree to these Terms and our Privacy Policy.

1. Acceptance of Terms

By visiting or purchasing through the Site you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding contract in the UAE. Your continued use of the Site constitutes acceptance of these Terms and of any changes we may make from time to time.

2. Site Usage

The Site is provided for your personal, non-commercial use. You may not copy, reproduce, modify, distribute, transmit or exploit any part of the Site for commercial purposes without our prior written consent.

3. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use and protect personal information in compliance with UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data (PDPL).

4. Accounts and Responsibility

If you create an account, you are responsible for:

• keeping your login credentials secure,
• all activities that occur under your account, and
• immediately notifying us of any unauthorised use.

We reserve the right to suspend or close any account if we suspect misuse or violation of these Terms.

5. Product Information

We aim to ensure product descriptions, images and specifications are accurate.
However, minor differences (such as colour or finish) may occur.
We may correct any errors, inaccuracies or omissions and update information at any time without prior notice.

6. Pricing and Payment

All prices are listed in UAE Dirhams (AED) and, where applicable, include Value Added Tax (VAT) in accordance with UAE Federal Decree-Law No. 8 of 2017.
Despite our best efforts, pricing errors may occur. If we discover an error after you place an order, we will notify you and give you the option to reconfirm or cancel the order.

Payment is processed through secure third-party gateways. We are not responsible for any failure or delay caused by the payment provider.

7. Orders, Cancellations, Refunds and Returns

Orders placed on the Site constitute an offer to purchase. We reserve the right to accept or reject any order at our discretion.

• Cancellations: You may cancel an order before it is dispatched by contacting us at the details below.
• Returns & Refunds: Returns are accepted and refunds provided in accordance with our separate Return & Refund Policy, in line with the UAE Consumer Protection Law (Federal Law No. 15 of 2020).
• Products must be unused and returned in original packaging unless defective.

8. Intellectual Property

All trademarks, logos, text, images, graphics, software and other content on the Site are the property of the Brand Owner or Rachna General Trading LLC under licence/NOC for the UAE.
You may not reproduce, distribute or create derivative works without the prior written permission of Rachna General Trading LLC or the Brand Owner, as applicable.

9. Limited Licence

We grant you a limited, non-exclusive and revocable licence to access and use the Site for personal, non-commercial purposes, subject to these Terms.

10. Security

You must not attempt to:

• breach or circumvent Site security,
• introduce viruses, malware or other harmful code, or
• interfere with the proper operation of the Site.

Unauthorised access may result in civil or criminal liability under applicable UAE law.

11. User Content

If you post reviews, comments or other material (“User Content”), you:

• grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce and display such content in connection with the Site, and
• warrant that you have the right to grant this licence and that the User Content does not infringe any third-party rights.

We reserve the right to remove any User Content we consider inappropriate or in breach of these Terms.

12. Representations and Warranties

The Site and all content are provided “as is” and “as available.”
We make no representations or warranties of any kind, express or implied, including but not limited to fitness for a particular purpose or non-infringement.

13. Limitation of Liability

To the fullest extent permitted by UAE law, we shall not be liable for:

• any indirect, consequential or incidental damages,
• loss of data, profits or revenue,
• or any other damages arising from your use of the Site or inability to access it.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence or for any other liability that cannot be excluded under UAE law.

14. Indemnity

You agree to indemnify and hold harmless Rachna General Trading LLC, its officers, employees and affiliates, and the Brand Owner, against any claims, losses, liabilities, damages or expenses (including legal fees) arising from:

• your breach of these Terms,
• your misuse of the Site, or
• your violation of any law or third-party rights.

15. Termination

We may suspend or terminate your access to the Site at any time without notice if you breach these Terms or if required by law.
On termination, your right to use the Site immediately ceases.

16. Governing Law and Jurisdiction

These Terms are governed by and shall be construed in accordance with the laws of the United Arab Emirates.
Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and other referenced policies, constitute the entire agreement between you and Rachna General Trading LLC regarding your use of the Site and supersede all prior agreements or understandings.

19. Changes to Terms

We may revise these Terms from time to time.
Updated versions will be posted on the Site with a revised “Last updated” date.
Your continued use of the Site after changes means you accept the updated Terms.
